Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the CaterDash website, marketplace, and related services (the “Platform”), operated by CaterDash Services Inc. (“CaterDash”, “we”, “us”, or “our”), a company incorporated under the laws of British Columbia, Canada.

1. Acceptance of Terms
By accessing or using the Platform, including browsing a storefront, placing an order, joining a group order, or submitting a corporate catering inquiry, you agree to be bound by these Terms and our Privacy Policy, which is incorporated by reference. If you do not agree, you must not use the Platform. If you are using the Platform on behalf of a company or other organization, you represent that you have authority to bind that organization to these Terms.
2. Definitions
- Vendor: the restaurant or food business that prepares the food you order. A Vendor's menu may be presented on the Platform under a storefront brand name that differs from the Vendor's legal or operating name.
- Partner: a business (which may operate one or more Vendors) with a menu listed on the Platform under a separate partner agreement.
- Order: a confirmed purchase of food and any related items from one or more Vendors.
- Group Order: an order type where a host creates a shared cart that individual participants add items to before the order is merged and submitted.
- Inquiry: a corporate catering request-for-quote submitted through the Platform's inquiry flow.
3. Eligibility & Accounts
You must be at least the age of majority in your province of residence and able to form a binding contract to use the Platform. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us promptly at team@caterdash.ca if you suspect unauthorized use of your account.
Some parts of the Platform (including Group Orders and Inquiry tracking) can be accessed without a full account, using a shared link or access token instead. You are responsible for keeping any such link or token confidential, as it may allow others to view or act on associated order information.
4. The Role of CaterDash
CaterDash operates an online marketplace that connects customers with independent Vendors for catering and food delivery. Unless expressly stated otherwise, CaterDash does not prepare, own, or sell the food listed on the Platform; each Order is fulfilled by the Vendor behind the storefront you ordered from. CaterDash facilitates order placement, payment processing, and delivery logistics, and provides customer support for issues arising from your use of the Platform.
5. Placing an Order
When you place an Order, you are making an offer to purchase the selected items at the displayed price, subject to acceptance by the fulfilling Vendor. Each Vendor may set its own minimum order value, required lead time, and modifier options (including assorted platter selections); these are displayed before checkout and are binding once your Order is confirmed.
We reserve the right to refuse or cancel any Order, including where: the Vendor is unable to fulfill it, pricing or availability information displayed on the Platform was in error, we suspect fraud or a violation of these Terms, or the delivery address falls outside a Vendor's serviceable area. If we cancel a confirmed Order, we will refund any amount already charged.
6. Group Orders
A Group Order allows a host to share a link so that participants can browse a Vendor's menu and add items to their own individual carts. The host is responsible for setting and communicating the order deadline, and for the final review and submission of the merged Order. The host may set a per-person budget: where permitted by the host's settings, a participant whose selections exceed that budget pays the excess with their own payment method when submitting their selections, and the balance of the merged Order is charged to the host at checkout. Multi-day Group Orders may be charged per day or as a single combined payment, as configured when the Group Order is created. If a Group Order is cancelled before submission, amounts pre-paid by participants are refunded to their original payment method.
Participants are responsible for the accuracy of their own item selections and dietary/modifier choices before the deadline set by the host. Once the host submits the merged Order, it is treated as a single Order under Section 5 and Section 9 of these Terms.
7. Corporate Catering Inquiries
Submitting an Inquiry through our corporate catering flow is a request for a quote; it is not a confirmed Order and does not obligate CaterDash or any Vendor to fulfill it. Each Inquiry is assigned a reference number and a private access token so you can track its status; keep this link confidential, as anyone with it can view the Inquiry's details. An Order arising from an Inquiry is only binding once you receive written confirmation and, where applicable, complete payment.
8. Pricing, Payment & Taxes
Displayed prices are set by each Vendor and may not include applicable delivery fees, service fees, gratuity, or taxes (GST, HST, PST, or QST as applicable to your province), all of which are calculated and shown before you confirm your Order. Payments are processed through our third-party payment processor, Stripe. CaterDash does not store your full payment card details on its own servers. By providing a payment method, you authorize us to charge it for your Order total, including any subsequent adjustments made in accordance with Section 9.
9. Cancellations, Changes & Refunds
Because Vendors prepare food to order, cancellation and change windows are generally shorter than for typical retail purchases and may vary by Vendor and Order size. To cancel or change a confirmed Order, contact us as soon as possible using the details in Section 18. Cancellations made after a Vendor has begun preparation may not be eligible for a full refund. Where an Order is edited by our team after confirmation (for example, to correct an item or quantity), fees and taxes are recalculated accordingly and any balance is charged or refunded to your original payment method.
Nothing in this section limits any non-waivable refund or cancellation right you have under applicable provincial consumer protection legislation, including British Columbia's Business Practices and Consumer Protection Act.
10. Delivery
You are responsible for providing an accurate delivery address and being reasonably available to receive your Order within the delivery window shown at checkout. Delivery windows are estimates and may be affected by traffic, weather, or Vendor preparation time. Risk of loss for delivered items passes to you (or, for a Group Order, the recipient at the delivery address) once the Order is delivered to the address provided.
11. Vendors & Food Quality
Vendors are independent businesses solely responsible for the preparation, quality, safety, and accuracy of the food they provide, including compliance with food safety regulations and the accuracy of allergen and dietary information they publish on the Platform. If you have a known food allergy or dietary restriction, confirm directly with the Vendor before ordering. CaterDash does not independently verify ingredient or allergen information submitted by Vendors.
12. Acceptable Use
You agree not to:
- Use the Platform for any unlawful purpose or in violation of these Terms;
- Submit false information when placing an Order or Inquiry;
- Attempt to access another user's account, Group Order, or Inquiry without authorization;
- Interfere with or disrupt the security or performance of the Platform; or
- Scrape, reverse-engineer, or resell access to the Platform without our written consent.
13. Intellectual Property
The Platform, including its design, text, graphics, and underlying software, is owned by CaterDash or its licensors and is protected by Canadian and international intellectual property laws. Vendor and storefront names, logos, and menu content remain the property of the respective Vendor or Partner. You may not copy, modify, or distribute any part of the Platform without prior written permission.
14. Disclaimers & Limitation of Liability
To the fullest extent permitted by law, the Platform is provided “as is” and “as available” without warranties of any kind, express or implied. CaterDash is not liable for the acts or omissions of any Vendor, including food quality, safety, or allergen accuracy. To the extent permitted by applicable law, CaterDash's total liability arising out of or related to your use of the Platform will not exceed the amount you paid for the Order giving rise to the claim in the twelve (12) months preceding it.
Nothing in these Terms excludes or limits any warranty, condition, or right that cannot lawfully be excluded or limited under applicable Canadian federal or provincial consumer protection law, including the Business Practices and Consumer Protection Act (British Columbia) or equivalent legislation in your province.
15. Indemnification
You agree to indemnify and hold CaterDash, its officers, directors, employees, and agents harmless from any claim, loss, or expense (including reasonable legal fees) arising from your breach of these Terms or your misuse of the Platform.
16. Governing Law & Disputes
These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict-of-law principles. If you are a consumer resident in another Canadian province, mandatory protections under the consumer protection legislation of your home province continue to apply. You and CaterDash agree to first attempt to resolve any dispute informally by contacting team@caterdash.ca. Subject to that, the courts located in British Columbia will have exclusive jurisdiction over any dispute not otherwise resolved.
17. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will update the “Effective” date above and, where appropriate, provide additional notice (such as an email or an in-Platform banner). Continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.
